By registering for and participating in this motorcycle course, I acknowledge, understand and agree to the following:
1. Risks of motorcycle riding
I understand that motorcycle riding is hazardous and may result in:
- a) Serious or fatal injury; and/or
- b) Damage to or loss of my property.
2. Release of liability
I agree that no claim will be made against Tasman Motorcycle Training Limited, its owners, officers, employees, instructors, contractors, agents, or any other persons associated with this course in respect of:
- a) Any degree of injury; and/or
- b) Any damage to or loss of property,
arising from or in connection with my participation in the course.
3. Indemnity
I indemnify Tasman Motorcycle Training Limited and all persons associated with this course against any and all claims, losses, costs, expenses, liabilities or proceedings incurred as a result of or in connection with my participation in the course.
4. Health and fitness
I confirm that I am in sound health and have no known physical or mental impairment that may affect my safety or the safety of other course participants.
5. Alcohol, drugs and medication
I confirm that I am not under the influence of alcohol, drugs or medication that may impair my understanding, ability, coordination, judgement or safe participation in the course.
6. Family, heirs and executors
I agree that the terms of this disclaimer are intended to apply to and be binding upon me and, to the extent permitted by law, my family, heirs and executors.
7. Motorcycle hire/use
If I use or hire a motorcycle belonging to Tasman Motorcycle Training Limited, I acknowledge and accept that I have no insurance cover under this agreement in respect of any damage, injury, death or loss caused by or arising from the motorcycle, any person or any property.
I acknowledge and accept that the motorcycle is provided to me at my own risk in respect of any damage, injury, death or loss arising from my use of the motorcycle, including any consequential loss suffered by the owner or any other party.
I accept that I may be liable to the owner or any other person for loss or damage to or arising from the motorcycle and any consequential loss, and I agree to indemnify the owner against any loss, claim, infringement notice, action or proceeding arising from my use or hire of the motorcycle.
